TOXcloud is an online service provider as defined in the Digital Millennium Copyright Act (DMCA). We provide a platform for users to upload, store, and share digital content. We take copyright violation very seriously and will vigorously protect the rights of legal copyright owners.

If you are a copyright owner or an agent thereof and believe that any content hosted on TOXcloud infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing:

• A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material that is claimed to be infringing or to be the subject of infringing activity, along with exactly providing the URL(s) to the allegedly infringing files.
• Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and email address.
• A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

TOXcloud does not actively monitor the content uploaded by users. Therefore, we do not guarantee the accuracy, integrity, or quality of such content. You understand that by using our services, you may be exposed to content that is offensive, indecent, or objectionable. Under no circumstances will TOXcloud be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the service.

3. File Retention & Data Loss

While we provide Smart Auto-Backups and utilize redundant cloud infrastructure to maintain the safety of your data, we cannot guarantee absolute protection against data loss due to unforeseen hardware failures, cyber-attacks, or force majeure events. Users are strongly advised to keep personal backups of their important files.

4. Mirror Links Disclaimer

Our system may automatically generate alternative download links (Smart Mirror Links) through third-party services (e.g., Mixdrop, Send.cm). TOXcloud is not responsible for the privacy practices, content policies, or availability of these third-party platforms. Using these links is at the user's own discretion and risk.
