Terms of Service - TOXcloud

1. Acceptance of Terms

By accessing and using TOXcloud ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access our services. We reserve the right to modify these terms at any time.

2. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the service.
You agree not to disclose your password to any third party.
You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Acceptable Use Policy

You agree not to use TOXcloud to upload, post, host, or transmit any content that:

Is illegal, threatening, defamatory, abusive, or harassing.
Infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party (See our DMCA Policy).
Contains software viruses, malware, trojans, or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware.
Involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing (spam).
Contains sexually explicit content involving minors or promotes violence and self-harm.

4. File Storage and Limits

While TOXcloud offers "unlimited" storage plans, this is subject to fair usage. We reserve the right to impose limits on bandwidth, storage space, and API requests to prevent abuse and ensure a stable experience for all users.

Files that remain inactive (no downloads) for an extended period (e.g., 90 days for free accounts) may be subject to automated deletion to free up server resources.

5. Intellectual Property Rights

You retain all of your ownership rights in your content. However, by uploading content to TOXcloud, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display that content solely for the purpose of operating and providing our services (including generating Smart Mirror Links).

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms of Service. Upon termination, your right to use the Service will immediately cease, and all your files may be permanently deleted.

7. Limitation of Liability

In no event shall TOXcloud, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
